Failure to Adhere to Safety Regulations Leads to Severe Injury and $700,000 Fine

DSJ Construction, a Jersey City company, was fined $700,000 (USD) for failing to comply with OSHA safety regulations, which resulted in a diabetic plumber becoming disabled and dependent.

The diabetic plumber was climbing down a ladder when he stepped on a nail protruding from wood left at a construction site in Jersey City by the general contractor or subcontractors that had performed framing on the construction site. 

While the injury appeared minor at first, the diabetic plumber suffered amputations of several toes on his left foot and other diabetic complications. Despite having been covered by Workers’ Compensation, there was additional liability, leading to this litigation against the non-employer defendants.

Kramlik's injury left him disabled and dependent. He said that "If they had complied with OSHA safety regulations, then he would be working today. A little safety can go a long way to prevent serious accidents ... and keep costs down."
